Ted readily agrees. “Let’s break down the probate process step-by-step. First, we need to determine if probate is even necessary. If the estate’s value falls below a certain threshold—$184,500 in California—or if assets are held in trust or joint tenancy, probate might be avoidable.”

“If probate is required,” he continues, “the next step involves filing a petition with the court and requesting to be appointed as executor or administrator of the estate. This usually involves submitting the original will (if one exists) along with other necessary documents. We then need to provide notice to interested parties—heirs, beneficiaries, and known creditors.”

“This is a crucial stage where we meticulously review the estate’s financial records to identify and pay valid creditor claims,” Ted says, leaning forward. “Think of it like tying up loose ends before moving forward with the distribution process. We also need to ensure that all applicable state and federal taxes are filed and paid on time.”
