“Certainly, Gina. One of the most common types of trusts I work with is the Revocable Living Trust. This type of trust allows individuals to maintain control over their assets during their lifetime while avoiding probate after they pass away. It’s a great option for many people because it provides both flexibility and privacy.
Moreover, a Revocable Living Trust can be amended or revoked as long as the grantor is alive and of sound mind. Consequently, this makes it adaptable to changing life circumstances, such as marriage, divorce, or the birth of a child.
However, it’s important to remember that a Revocable Living Trust becomes irrevocable upon the grantor’s death. At that point, the trust assets are distributed according to the grantor’s wishes as outlined in the trust document.

Steve, have you ever encountered any challenges when setting up or administering a Revocable Living Trust?
“Yes, occasionally. One instance involved a client who forgot to update their trust after a major life event. Their children had grown and were no longer minors, but the trust still listed them as beneficiaries under the original terms. This required a supplemental amendment to the trust document to ensure that the assets were distributed according to the client’s current wishes.
Another time, I worked with a couple who hadn’t fully discussed their individual desires regarding asset distribution. This led to some disagreements after one spouse passed away. Open communication and careful planning are crucial when creating a trust to avoid potential conflicts in the future.”
