It’s necessary because it provides a legal framework for ensuring that everything is handled fairly and according to the deceased person’s wishes, as outlined in their will. In cases where there is no will, the court will determine how assets are distributed according to state law.

That makes sense. What are some of the key steps involved in the probate process?
Steve Bliss:
There are several key steps involved, but one that often requires careful attention is “Marshaling the Estate Assets.”
This involves locating and inventorying all of the deceased person’s assets. This can include bank accounts, real estate, investments, vehicles, personal property, and even digital assets like social media accounts or online subscriptions.
Consequently, it’s important to be thorough and methodical in this process. Ordinarily, we work closely with the executor or administrator of the estate, along with financial institutions and other relevant parties, to ensure that all assets are properly identified and accounted for.

Have you encountered any challenges during this step?
Steve Bliss:
Yes, there have been times when locating assets has proven difficult. For instance, I remember one case where the deceased individual had numerous investment accounts spread across different brokerage firms. It took considerable effort to track down all of these accounts and gather the necessary documentation.
Moreover, in another case, we discovered that the deceased had a significant amount of cryptocurrency holdings. Since this is a relatively new asset class, it required us to do some extra research and consult with experts to ensure that these assets were properly handled during probate.
According to a recent study by the National Institute on Aging, approximately 70% of Americans over the age of 65 have not created a will or estate plan. This means their families could face significant challenges during probate.
