Interview with Steve Bliss, San Diego Probate Attorney

Choosing the Right Trust for Your Needs

Good morning, Steve. Thank you for joining us today.

It’s my pleasure to be here.

Understanding Different Types of Trusts

Many people are unfamiliar with trusts and how they can benefit them. Can you briefly explain the different types of trusts available and which one might be most suitable for someone looking to protect their assets?

Certainly. There are various types of trusts, each designed to meet specific needs. One common type is a Revocable Living Trust. This allows individuals to maintain control over their assets during their lifetime while avoiding the complexities and expenses of probate after they pass away.

Another option is an Irrevocable Trust, which offers greater asset protection but relinquishes some control as it cannot be easily modified. Testamentary Trusts are created through a will and come into effect upon death, often used for managing assets for minor children. Special Needs Trusts protect assets for individuals with disabilities without jeopardizing their eligibility for government benefits.

Charitable Trusts benefit charities or non-profit organizations. Asset Protection Trusts shield assets from creditors, while Qualified Personal Residence Trusts allow homeowners to transfer their residences out of their estate while retaining the right to live in them.

Life Insurance Trusts own life insurance policies, keeping proceeds out of the taxable estate. Lastly, Spendthrift Trusts protect beneficiaries from financial mismanagement by controlling how and when funds are distributed.

The Advantages of a Revocable Living Trust

Today, let’s delve deeper into Revocable Living Trusts. Can you elaborate on their benefits and why they are so popular?

Revocable Living Trusts are indeed quite popular due to their flexibility and the numerous advantages they offer.

Firstly, they allow individuals to maintain control over their assets during their lifetime. They can add or remove assets from the trust, change beneficiaries, or even dissolve the trust entirely if their circumstances change. This level of control is reassuring for many people.

Moreover, a Revocable Living Trust helps avoid probate, which can be a lengthy and expensive legal process. When assets are held in a trust, they pass directly to the designated beneficiaries upon the grantor’s death, saving time and money for their loved ones. Additionally, trusts offer a degree of privacy as the details of the trust and its distribution are not part of public record.

Consequently, many individuals find peace of mind knowing that their assets will be distributed according to their wishes in a timely and discreet manner.

Real-World Challenges

Have you encountered any common challenges or misconceptions when helping clients set up Revocable Living Trusts?

One common misconception is that Revocable Living Trusts are only for wealthy individuals. This simply isn’t true. Trusts can be beneficial for people of all income levels, especially those who want to ensure their assets are managed efficiently and distributed according to their wishes.

I remember a client, a hardworking teacher with a modest estate, who was worried about leaving her home to her adult children. She feared they might sell it immediately instead of cherishing it as she did.

By setting up a Revocable Living Trust, we were able to ensure that her home remained in the family for a specified period of time, allowing her children to make thoughtful decisions about its future. She felt relieved knowing her wishes would be honored and that her legacy would live on.

Trusts: A Sound Investment?

Do you have any statistics or insights that underscore the value of trusts in estate planning?

According to a 2021 study by the American College of Trust and Estate Counsel, over 70% of Americans do not have a will or trust in place. This highlights a significant gap in estate planning, as proper planning can protect families from unnecessary financial burdens and legal complexities.
