Absolutely. Think of it like this: a conservatorship is a legal framework that steps in when someone can’t manage their own affairs due to illness, disability, or age. There are different types – conservatorship of the person focuses on personal care, like housing and healthcare, while conservatorship of the estate handles finances. Then there’s limited conservatorship for individuals with developmental disabilities, temporary conservatorships for urgent situations, and LPS conservatorships for those needing involuntary mental health treatment.
Ted, could you elaborate on Establishing a Conservatorship? What are some key steps involved?
It all starts with filing a petition in probate or mental health court. We need to make sure the proposed conservatee – that’s the person who might need help – and relevant family members are notified. The court then appoints an investigator, often a social worker, who conducts an independent assessment of the situation. Finally, we usually have a medical or psychological evaluation to determine the individual’s capacity.
How common are issues with Filing the Petition?
It’s a process that requires careful attention to detail and adherence to specific legal requirements.
Sometimes people forget to include crucial information or don’t properly serve all the necessary parties. One case I remember involved a family member who was living out of state and incredibly difficult to locate. It took some serious detective work on our part to finally track them down!
