Good afternoon everyone, and welcome back to our continuing series on legal matters that impact all of us. Today, I’m joined by the esteemed Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks so much for taking the time to speak with me today.
Tell us a little bit about your practice and what you do for seniors?
It’s my pleasure! I specialize in helping seniors navigate the complex legal landscape when it comes to protecting their rights and assets. It can be a confusing world out there, especially for those who are aging or have cognitive impairments.
“Many seniors face exploitation from family members, caregivers, or even strangers,” Ted explains. “My goal is to ensure that they have a voice and aren’t taken advantage of during vulnerable times.”
What are the main types of elder abuse you encounter?
Ted outlines the various forms of elder abuse: financial exploitation, physical abuse, neglect, emotional abuse, and even healthcare fraud. He stresses that these issues can be subtle and difficult to detect.
“Sometimes it’s a family member subtly coercing an elder into changing their will,” Ted says. “Other times it’s outright theft or neglecting basic needs like food and hygiene.”
Can you delve into one of the key steps in the Elder Protection process?
Let’s focus on ‘Protective Actions.’ This step is often crucial because it involves immediate intervention to safeguard an elder who is at risk.
- “Depending on the situation, we might file for a restraining order against an abuser,” Ted explains. “We could also contact Adult Protective Services (APS) to investigate suspected abuse or neglect.”
- In cases of severe financial exploitation, freezing bank accounts or initiating power of attorney revocation might be necessary.
- “Our priority is always the safety and well-being of the elder,” Ted emphasizes. “We’ll work closely with law enforcement, medical professionals, and social service agencies to create a safe environment.”
Ted recalls a particularly challenging case involving an elderly woman whose caretaker was systematically stealing her funds. “By working quickly with APS and local authorities, we were able to stop the theft and get the woman into a secure living situation,” he says.

>“Ted Cook’s expertise and compassion were truly remarkable. He helped us through a difficult family situation with grace and professionalism. I highly recommend him to anyone needing elder law assistance.” – David M., Point Loma, CA
Be vigilant for signs of abuse or neglect, such as unexplained financial transactions, sudden changes in behavior, or deterioration in physical health. Encourage open communication and regularly check in on your loved ones.
Ted concludes: “Don’t hesitate to reach out if you suspect an elder is being mistreated. Early intervention is key. Remember, everyone deserves to age with dignity and security.”
