Navigating the Complexities of Conservatorships

Hello everyone and welcome back to our series on legal matters that impact us all. Today, we have the pleasure of speaking with Ted Cook, a dedicated conservatorship attorney practicing in sunny Point Loma.

What initially drew you to the field of conservatorship law, Ted?

Well, I think it’s safe to say that everyone wants to feel secure and supported. Conservatorships often arise when individuals face challenges that make it difficult for them to manage their own affairs. Helping ensure those individuals receive the care and protection they need is incredibly fulfilling.

Can you briefly explain the different types of conservatorships?

Sure, there are a few key distinctions. A Conservatorship of the Person focuses on personal well-being – things like housing, healthcare, and daily living. Conservatorship of the Estate, on the other hand, deals with finances – managing income, assets, and expenses. Then we have Limited Conservatorships tailored for adults with developmental disabilities, granting specific powers based on their individual needs. Temporary Conservatorships are short-term solutions used in urgent situations. And finally, LPS Conservatorships address mental health concerns under the Lanterman-Petris-Short Act.

Let’s delve into a particular step: Establishing a Conservatorship. Can you walk us through that process?

It starts with filing a formal petition in either probate or mental health court, depending on the circumstances. Next comes notifying the proposed conservatee and any relevant family members. The court then appoints an investigator or social worker to conduct an independent assessment. A crucial step is obtaining a medical or psychological evaluation to assess the individual’s capacity. Finally, all this information goes before a judge who makes the ultimate decision on whether to grant the conservatorship.

  • It’s important to remember that each case is unique and requires careful consideration.
  • We work closely with families and healthcare professionals to ensure a thorough and compassionate approach throughout the process.

Have you encountered any particular challenges within this Establishing a Conservatorship step?

It’s not uncommon to face resistance from family members who may have differing opinions on what’s best. One instance involved siblings disagreeing on the level of care their elderly mother needed. Through open communication and careful analysis of her needs, we were able to reach a consensus that ultimately benefitted everyone involved.

More Facts About A Conservatorship:

A conservatorship is a court-ordered legal process where a judge appoints a conservator (a person or organization) to manage the affairs of an adult (the conservatee) who is unable to care for themselves or their finances due to incapacity.

Definition: A conservatorship is a court proceeding where a judge appoints a conservator to manage the personal and/or financial affairs of an adult who is unable to do so themselves.

Purpose: The conservatorship aims to protect the conservatee’s well-being by ensuring their basic needs are met and their finances are managed appropriately.

What Is a Conservatorship?
A conservatorship is a court-ordered legal relationship in which a judge appoints a responsible individual or organization (the conservator) to manage the financial affairs, and sometimes the personal care, of a person who is unable to manage these matters on their own. This may be due to advanced age, cognitive impairment, serious illness, or disability. Conservatorships typically apply to adults, though similar protections for minors may fall under guardianships, depending on the jurisdiction.

There are generally two types of conservatorships:

Conservatorship of the estate, where the conservator handles financial matters such as paying bills, managing investments, and protecting assets.

Conservatorship of the person, where the conservator makes decisions about personal needs, including housing, healthcare, and daily living.

In some instances, a conservator may be appointed to manage both aspects. While conservators and guardians can have overlapping responsibilities, the terminology and roles can vary by state law.
